At Léonce Lemmens ART, original artworks are carefully packaged and shipped. As each artwork is unique and handmade, we kindly ask you to inspect the artwork carefully upon delivery.

For online purchases made by consumers, the statutory right of withdrawal applies unless a legal exception applies.

Right of withdrawal – original artworks

If you are a consumer and have purchased an original artwork online that has not been specifically made for you, you have the legal right to withdraw from the purchase within 14 days of receiving the artwork, without giving a reason.

The withdrawal period begins on the day after you, or a third party designated by you other than the carrier, receives the artwork.

If you wish to exercise your right of withdrawal, you must clearly inform us within this period that you wish to cancel the purchase.

You may send an email with the subject “Withdrawal”, including your name, order number and the artwork concerned.

Returning the artwork

After notifying us of your withdrawal, you must return the artwork within 14 days.

The artwork should be returned carefully packaged and preferably in its original packaging. The cost and risk of returning the artwork are borne by the customer, unless otherwise agreed or unless applicable law requires Léonce Lemmens ART to bear these costs.

As original artworks may be fragile and valuable, we strongly recommend returning the artwork using a trackable and insured shipping service.

Condition of the artwork

You may handle and inspect the artwork only to the extent necessary to establish its nature, characteristics and functioning, as you would reasonably be allowed to do in a gallery or shop.

If the artwork has been handled beyond what is necessary for such an assessment, you may be liable for any resulting reduction in value.

The artwork must therefore be handled carefully and returned without damage.

Refund
Following a valid withdrawal, you will receive a refund of the purchase price, including the standard cost of the original delivery.

If you selected a more expensive delivery method than the least expensive standard delivery option, the additional cost of the more expensive method will not be refunded.

The refund will be made within 14 days after we have received your notice of withdrawal. We may withhold the refund until we have received the returned artwork or until you have provided evidence that the artwork has been returned, whichever occurs first. 

The refund will be made using the same payment method used for the original purchase, unless otherwise agreed with you.

Artwork damaged upon delivery

If the artwork arrives damaged, please contact us as soon as possible, preferably within 48 hours of delivery.

Where possible, please provide photographs of:
- the packaging;
- any damage to the packaging;
- the artwork;
-the shipping label.

Please keep the original packaging until the matter has been resolved.

We will then work with you to find an appropriate solution.

Incorrect or defective artwork

If you have received an artwork other than the one you ordered, or if the artwork has a defect for which Léonce Lemmens ART is responsible, please contact us as soon as possible.

In such cases, your statutory consumer rights apply. These rights are separate from the statutory right of withdrawal.

Exceptions

The right of withdrawal does not apply where a statutory exception applies, including products made according to the consumer's specifications or clearly personalised for the consumer.

Retourneren

Bij Léonce Lemmens ART worden originele kunstwerken met zorg verpakt en verzonden. Omdat ieder kunstwerk uniek en met de hand gemaakt is, verzoeken wij je om het kunstwerk na ontvangst zorgvuldig te controleren.

Voor online aankopen door consumenten geldt het wettelijke herroepingsrecht, tenzij een wettelijke uitzondering van toepassing is.

Herroepingsrecht – originele kunstwerken
Wanneer je als consument een origineel kunstwerk online hebt gekocht dat niet speciaal voor jou is gemaakt, heb je het recht om de overeenkomst binnen 14 dagen na ontvangst van het kunstwerk zonder opgave van reden te herroepen.

De herroepingstermijn begint op de dag nadat jij, of een door jou aangewezen derde die niet de vervoerder is, het kunstwerk hebt ontvangen.

Wil je gebruikmaken van het herroepingsrecht, dan dien je ons binnen deze termijn duidelijk te laten weten dat je de aankoop wilt herroepen.

Je kunt een e-mail sturen met als onderwerp “Herroeping”, onder vermelding van je naam, ordernummer en het betreffende kunstwerk.

RetourzendingNa het melden van de herroeping dien je het kunstwerk binnen 14 dagen aan ons terug te sturen.

Het kunstwerk moet zorgvuldig en bij voorkeur in de originele verpakking worden teruggestuurd. De kosten en het risico van de retourzending zijn voor rekening van de klant, tenzij anders overeengekomen of wanneer sprake is van een wettelijke verplichting voor Léonce Lemmens ART om deze kosten te dragen.

Omdat originele kunstwerken kwetsbaar en waardevol kunnen zijn, raden wij aan de retourzending verzekerd en met track & trace te versturen.

Staat van het kunstwerk

Je mag het kunstwerk bekijken en beoordelen zoals je dat in een galerie of winkel zou mogen doen.

Wanneer het kunstwerk verder is gebruikt of behandeld dan noodzakelijk is om de aard, kenmerken en werking ervan te beoordelen, kan een waardevermindering worden doorberekend.

Het kunstwerk dient daarom zorgvuldig te worden behandeld en zonder beschadigingen te worden geretourneerd.

Terugbetaling

Na een geldige herroeping ontvang je het aankoopbedrag terug, inclusief de standaardkosten voor de oorspronkelijke verzending.

Wanneer je hebt gekozen voor een duurdere verzendmethode dan de goedkoopste standaardlevering, worden de extra kosten voor deze duurdere methode niet terugbetaald.

De terugbetaling vindt plaats binnen 14 dagen nadat wij de herroeping hebben ontvangen. Wij mogen wachten met terugbetaling totdat wij het kunstwerk retour hebben ontvangen of totdat je hebt aangetoond dat het kunstwerk is teruggestuurd, afhankelijk van welk moment het eerst plaatsvindt. 

De terugbetaling wordt uitgevoerd via dezelfde betaalmethode die voor de oorspronkelijke aankoop is gebruikt, tenzij anders met jou is overeengekomen.

Beschadigd aangekomen kunstwerk

Is het kunstwerk bij ontvangst beschadigd? Neem dan zo snel mogelijk contact met ons op, bij voorkeur binnen 48 uur na levering.

Maak indien mogelijk foto's van:
- de verpakking;
- eventuele beschadigingen aan de verpakking;
- het kunstwerk;
- het verzendlabel.Bewaar de originele verpakking totdat de situatie is opgelost.

Wij zullen vervolgens samen met jou naar een passende oplossing zoeken.

Verkeerd of gebrekkig geleverd

Wanneer je een ander kunstwerk hebt ontvangen dan besteld, of wanneer sprake is van een gebrek waarvoor Léonce Lemmens ART verantwoordelijk is, verzoeken wij je zo snel mogelijk contact met ons op te nemen.

In dergelijke gevallen geldt het wettelijke consumentenrecht. Dit staat los van het wettelijke herroepingsrecht.

Uitzonderingen

Het herroepingsrecht geldt niet wanneer een wettelijke uitzondering van toepassing is, waaronder producten die volgens de specificaties van de consument zijn vervaardigd of duidelijk voor een specifieke persoon bestemd zijn.
